2. Rider eligibility
By signing, the rider confirms that:
- they are 18 or older, or 16 or 17 with a parent or guardian who signs this agreement with them at pickup;
- they are an experienced mountain biker, competent on the trail grades they intend to ride;
- they are fit to ride and know of no health condition or injury that makes riding unsafe for them;
- their height and weight, as given to Outset, are accurate, so the bike can be set up correctly and kept within the manufacturer's rider weight limit;
- they will not ride under the influence of alcohol, drugs or medication that affects their riding.
3. Acknowledgement of risk
Mountain biking can cause serious injury or death, even when the rider is careful and the bike is in good condition. The rider chooses to ride and accepts these risks.
Risks include:
- falls and crashes on steep, loose, wet, rooty or rocky ground, jumps, drops and other trail features;
- collisions with other trail users, vehicles, animals, trees and structures;
- changing weather, poor light, and riding in remote places where help may be slow to arrive;
- equipment failure, which can happen even on a well-maintained bike.
Risks specific to electric mountain bikes:
- the bike is much heavier than a standard mountain bike, which changes handling and increases braking distance;
- motor assistance can make the bike surge forward, particularly when starting off or on steep climbs;
- assisted climbing makes it easy to reach terrain that is harder to ride down than the rider expects;
- a flat battery can leave the rider pushing a heavy bike a long way.
4. Rider responsibilities
The rider agrees to:
- wear a properly fitted helmet at all times when riding; gloves, eye protection and pads are recommended;
- ride within their ability and only on trails suited to it, and follow trail grades, closures, signs and land manager rules, including where e-bikes are permitted;
- follow NZ road rules when riding on roads;
- be the only person who rides the bike, and not lend or sub-hire it;
- not use the bike for racing (uplift, shuttle riding and bike parks are allowed);
- not modify the bike or change its suspension, tyre pressures or controls, other than saddle height;
- not open, tamper with or pressure-wash the motor, battery or electrical parts, and charge the battery only with the charger Outset supplies on overnight and longer hires;
- lock the bike to a fixed object with their own lock whenever it is left unattended, and transport it securely;
- stop riding and contact Outset on 09 280 4450 after a crash or if the bike develops a fault.
5. Bike condition and setup
Outset supplies the bike serviced and safe to ride, and sets up the suspension, tyre pressures and controls for the rider at pickup.
- The rider and Outset staff check the bike together at pickup and record any existing marks or damage.
- Before each ride, the rider checks the brakes, tyres and wheel axles.
- If the bike develops a fault, the rider stops riding and contacts Outset. The rider may fix a puncture but must not attempt other repairs.
6. Damage, loss and theft
The rider is responsible for the bike from pickup until it is checked back in at Outset.
- Fair wear and tear (normal tyre and brake pad wear, mud, minor scuffs from normal riding) is Outset's cost.
- Damage beyond fair wear and tear, including from crashes, misuse or transport, is the rider's cost: the reasonable cost of repairing or replacing the damaged parts at Outset's standard workshop rates and parts prices, up to the replacement value of the bike.
- Loss or theft is the rider's cost, up to the replacement value of the bike. Theft must be reported to Police and Outset within 24 hours.
- The replacement value is the bike's current retail price on outset.bike at the time of the damage, loss or theft.
- Outset gives the rider an itemised quote before charging for any damage.
- Card hold or bond: at pickup, Outset places a $1,000 hold on the rider's credit card, or the rider pays a $1,000 cash bond instead. The hold is released, or the bond refunded, when the bike is checked back in, less any charges under this agreement.
7. Return, late return and cancellation
- Same-day hire: return the bike by closing time on the pickup day (Monday to Friday 18:00, Saturday 13:00).
- Overnight and longer hires: return by 10:00 on the return date. Outset is closed on Sundays, so a Saturday overnight hire returns on Monday.
- Late return: $50 for each hour late, unless the rider calls Outset before the bike is due and agrees a later return. If the bike is not returned within 24 hours of the due time and the rider cannot be reached, Outset may report it to Police as stolen.
- Cleaning: a $50 fee may apply if the bike comes back excessively dirty.
- Cancellation: please give at least 48 hours' notice. There is no cancellation fee. Outset may cancel if the bike is unsafe or unavailable; no fee is charged.
8. Demo fee credit
For a Demo booking, the fee is refunded, or deducted at the time of payment, if the rider buys any new bike from Outset within 60 days of the demo. The credit has no cash value otherwise and applies once per purchase.
9. Liability and your consumer rights
Nothing in this agreement limits the rider's rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Outset will supply the bike with reasonable care and skill, and fit for its purpose.
- Personal injury in New Zealand is generally covered by ACC. This agreement does not change that.
- To the extent the law allows, Outset is not responsible for loss of or damage to the rider's own property, or for indirect losses such as travel or accommodation costs, unless caused by Outset's failure to take reasonable care.
- The rider is responsible for damage or injury they cause to other people or property while using the bike.
10. Privacy
Outset collects the rider's details to manage the booking, set up the bike, contact the rider, and recover the bike if needed. Details are stored in Outset's booking system and customer database and are not sold. Photo ID and proof of address are sighted, not copied. The rider can ask to see or correct their information under the Privacy Act 2020 by emailing hello@outset.bike. Marketing emails are sent only if the rider opts in separately.
